Forensic Director - Transaction Disputes

As a Director and Engagement Leader within our Transaction Disputes team, you will be expected to lead and successfully deliver challenging and complex Forensic Transaction Dispute engagements for a wide range of corporate businesses.

Leading our Transaction Disputes proposition, you will be expected to originate opportunities through both internal and external relationships and will take the lead on business development activities, including marketing, knowledge sharing and practice development. You will be involved in providing advice and support in connection with completion accounts and earn-out disputes arising out of M&A transactions. Whilst Transaction Disputes will be your primary focus, you may also be involved in other types of dispute engagement.

Key responsibilities within the role will include:

  • Working alongside the Deal Advisory Sales Purchase Agreements (SPA) Team during the pre-dispute phase, supporting the client in its negotiations, and helping them assess the strengths and weaknesses of their case
  • Where there is no negotiated settlement, to help clients identify and appoint an independent accountant as expert determiner
  • Draft submissions on behalf of the client, arguing their case in front of the expert
  • Act as the independent expert to determine the dispute.
  • Preparation of reports and sections thereof for Partner review
  • Managing the risks and financials associated with client engagements
  • Developing a profile in the market in order to be a credible Expert on disputes where KPMG may be approached to carry out expert determinations
  • Developing and overseeing career management for team members

The Person

  • A Chartered Professional Accountant (or equivalent)
  • Extensive experience of the completion accounts/earn-out dispute resolution process
  • Excellent general accounting skills and knowledge
  • A logical and methodical thinker, capable of interpreting the contractual wording of the price adjustment mechanism and structuring and drafting complex and nuanced arguments in a way that is clear and persuasive.
  • Ability to review and challenge effectively drafts produced by team members.
  • Demonstrable experience of managing projects, including financial and risk management
  • Experience in scoping and defining Forensic projects
  • Commercial awareness and proven track record of managing the risks and financials associated with client engagements
  • Proven ability to lead and manage teams
  • Ability to articulate complex and technical findings in both written and oral presentations for a variety of audiences
  • Excellent analytical and problem-solving skills, self-motivation and an enquiring mind
  • Experience in business development activities and an enthusiasm to get involved in marketing activity and in developing the Sectors I&C practice
  • A developed network of relevant contacts
  • Strong people development skills with the ability to inspire and develop junior colleagues
  • Experience of advising on SPAs pre-deal is desirable
